Important: these Terms include your consent to be contacted by phone and text (Section 5), text message program terms (Section 6), and a binding arbitration agreement with a class action waiver (Section 12). Please read them carefully.
These Terms of Use ("Terms") are an agreement between you and Homy-Us.com ("Homy," "we," "us") and govern your use of homy-us.com (the "Website"). By using the Website or submitting a request, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Website.
1. What Homy does
Homy is a free marketing and lead generation service. You tell us about a home improvement project, and we connect you with independent contractors and marketing partners who may contact you with quotes, products or services. Homy is paid by these partners, not by you.
Homy does not perform home improvement work, is not a contractor, and does not employ, endorse, license or guarantee any contractor or partner. We do not guarantee that you will be matched, contacted or receive a quote, or the price, quality, timing or outcome of any work. Before hiring anyone, check their license, insurance, references and written contract. Any agreement you make is only between you and that company.
2. Eligibility
You must be at least 18 years old and live in the United States to use the Website.
3. Your information
You agree that the information you submit is true, accurate and your own, and that the phone number you provide is yours or one you are authorized to use. You may not submit information about another person without their permission. You authorize us to share your submission with our contractors and marketing partners as described in the Privacy Policy.
4. Prohibited uses
You may not submit false or fraudulent requests, use bots or automated tools to submit forms or collect data, interfere with the Website's operation, or use the Website for any unlawful purpose.
5. Consent to be contacted
By clicking "Get free quotes," you give your express written consent for Homy and its marketing partners to contact you at the phone number you provided, including by calls and text messages made with an automatic telephone dialing system or other automated technology, an artificial or prerecorded voice, or an AI-generated voice, about home improvement products and services, even if your number is on a federal, state or company Do Not Call list. You also agree to receive emails at the address you provided. Your consent is not a condition of purchasing any goods or services; to request help without giving this consent, email us at support@homy-us.com.
You may withdraw your consent at any time by any reasonable means, including replying STOP to a text message, telling a caller you no longer want to be contacted, or emailing support@homy-us.com. If your phone number changes or is reassigned, please tell us. You agree to let us know if you are no longer the user of the number you provided.
6. Text message program terms
- Program: Homy home improvement quotes. Texts relate to your project request and related offers from Homy and its partners.
- Frequency: message frequency varies.
- Cost: message and data rates may apply.
- Opt out: reply STOP at any time. You will receive one message confirming you are unsubscribed.
- Help: reply HELP or email support@homy-us.com.
- Carriers are not liable for delayed or undelivered messages.

7. Third parties
Contractors, partners and websites linked from the Website are independent third parties. We are not responsible for their content, services, privacy practices or conduct. Your dealings with them are solely between you and them.
8. Intellectual property
The Website, including its text, design, images and the Homy name and logo, belongs to Homy or its licensors. You may use the Website only for your personal, non-commercial use.
9. Disclaimers
The Website and services are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. Homy does not warrant that the Website will be uninterrupted or error-free, or make any warranty about any contractor or partner.
10. Limitation of liability
To the fullest extent permitted by law, Homy will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any damages arising from work performed or not performed by any contractor or partner. Homy's total liability for any claim relating to the Website is limited to one hundred U.S. dollars ($100).
11. Indemnity
You agree to defend and indemnify Homy against claims, losses and costs (including reasonable attorneys' fees) arising from your misuse of the Website, your violation of these Terms, or information you submit that is false or not your own.
12. Arbitration agreement and class action waiver
Except for claims that qualify for small claims court, any dispute between you and Homy relating to the Website or these Terms, including claims under the Telephone Consumer Protection Act, will be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules, rather than in court. The arbitration may be held by video or phone. You and Homy waive the right to a jury trial and to participate in a class, collective or representative action.
You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing support@homy-us.com with the subject "Arbitration Opt-Out" and your name, email and phone number. If this section is found unenforceable, the class action waiver will still apply to the extent permitted by law.
13. Governing law
These Terms are governed by the Federal Arbitration Act and the laws of the State of Texas, without regard to its conflict of law rules.
14. Changes
We may update these Terms from time to time. The updated Terms apply from the date shown at the top. Your continued use of the Website after a change means you accept it.
15. General
If any part of these Terms is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms and the Privacy Policy are the entire agreement between you and Homy about the Website.
